End-user Licensing Agreement/permission to collect and process your data

Before using the software, please read this End-user Licensing Agreement (“Licence”) carefully. By using the software, you agree to the terms of this Licence. If you do not agree to the terms of the license, the agreement authorising use is not formed and you cannot use the software.
This Licence is a legally binding agreement between you and Emergency Response Centre Agency Finland, P.O. Box 112, 28131 Pori, Finland, business ID 2409452-3 (“ERC Agency”). This License defines your rights and obligations in relation to the 112 Suomi application of the ERC Agency and its licensors (collectively “Third Parties”), including updates/improvements provided by the ERC Agency and all documentation (collectively the “Software”).

If a Software includes another piece of software with a separate licensing agreement (such as open source software), this separate licensing agreement applies to the other software. In this cases, the terms of the separate licensing agreement apply instead the terms of this Licence.

Intellectual property rights

All rights (including copyright) and ownership of the Software belong to the ERC Agency or a Third Party.

Licence to use the Software

This agreement grants a licence to use the Software. For the sake of clarity, it is noted here that the Software is protected by copyright as well as by other laws and international treaties on intellectual property rights, and that this agreement does not confer such rights or ownership. The ERC Agency grants you a limited right to use the Software on a compatible device (“Device”) for your personal, non-commercial use only. 

Terms and restrictions

You do not have the right to copy, publish, edit, distribute, attempt to read the source code, alter, translate into the original language or otherwise disassemble the Software in whole or in part or use the Software to create derivative works. You have no right to override, edit, render meaningless or circumvent any of the functions or protections in the Software or any mechanisms related to the functioning of the Software. You do not have the right to separate any individual component of the Software to use on more than one Device unless expressly permitted by the ERC Agency. You do not have the right to remove, edit, cover or damage any of the trademarks or notifications in the Software. You do not have the right to distribute, spread, rent, lease, sublease, assign, transfer or sell the Software.

Open source components

You accept that the Software may include open source software that may be subject to the terms of use for open source software. This means all software licenses approved by the Open Source Initiative as open source licenses and any essentially similar licenses.

Waiving of warranty

You accept and agree that your use of the Software is entirely at your own risk and that you are liable for your use of the Software. The software is provided “as is”, without any warranty, commitment or condition.

The ERC Agency and each of the Third Parties explicitly waive all explicit and indirect warranties, commitments and conditions, including but not limited to indirect warranties related to saleability, non-infringement or applicability for a particular purpose. The ERC Agency does not guarantee or offer a warranty 

  • that the functions included in the Software
  • meet your requirements or that the functions are updated, 
  • that Software functions correctly or error-free or that any errors are corrected, 
  • that the Software does not cause damage to other software, hardware or data, 
  • that any software, web services (including the internet) or products (other than software) on which the operation of the Software depends remain available, uninterrupted or unaltered, or 
  • on the use of the Software or the results of using the Software with respect to accuracy, reliability of use or otherwise.

Limitation of liability

Neither the ERC Agency nor any Third Party shall be liable for any indirect or collateral damage arising from a breach of explicit or indirect warranty, breach of contract, negligence, strict liability or any other legal theory with respect to the Software, including but not limited to damages for lost profits, lost revenue and lost data, as well as damage caused by the Software or related hardware being unusable, or damage caused by the time lost due to an interruption of use of the Software or the time lost by the user, even if the possibility of such damage has been announced. In all cases, the liability for damages of the parties and the total liability on the basis of any of the terms of this licence is limited to 50 euros.

Permission to collect and process location and personal data

The ERC Agency uses the Software to provide a service that allows the emergency response centre to track the location of persons who call the 112 emergency number. The Software is also used to provide a service where the location of persons who call the maritime search and rescue services emergency number can be tracked by the Maritime Rescue Command Centre. Similarly, the location of persons who call the Road Users’ Hotline can be tracked by the Traffic Management Centre. The services provided through the Software are thus dependent on location data, particularly the geographical location of the Device. You accept that, for the purposes of providing these services, the ERC Agency and the emergency response centre may collect, archive, process and use this type of location data. You also accept that when calling the maritime search and rescue services emergency number, the Maritime Rescue Command Centre may collect, archive, process and use this type of location data. You also accept that when calling the Road Users’ Hotline, the Traffic Management Centre may collect, archive, process and use this type of location data. The above location data is monitored for a maximum of one (1) hour after the end of a call to the emergency response centre, maritime search and rescue services or the Road Users’ Hotline, and this data may be used depending on the dialled number for the needs of either the ERC Agency, maritime search and rescue services or the Traffic Management Centre in accordance with these principles of data protection. 

You also accept that the ERC Agency may collect and temporarily store personal data obtained using the Software, in particular your phone number the location of the Device and, if necessary, transmit this information to the emergency response centre. You also accept that when calling maritime search and rescue services, the ERC Agency may collect and temporarily store personal data obtained using the Software, in particular your phone number the location of the Device and, if necessary, transmit this information to the Maritime Rescue Command Centre. You also accept that when calling the Road Users’ Hotline, the ERC Agency may collect and temporarily store personal data obtained using the Software, in particular your phone number the location of the Device and, if necessary, transmit this information to the Traffic Management Centre. The purpose of transmitting the data is to perform necessary measures in response to the call to the emergency response centre, maritime search and rescue services or the Road Users’ Hotline. Collected data is stored temporarily for a maximum of twenty-four (24) hours.

Changes to the Software may change the personal data or other data collected stored or transmitted using the Software or the authorities or other parties to whom the necessary data is transmitted on a case-by-case basis.

The ERC Agency or its partners will not use the data to identify individuals who use the Software or Device without the user's awareness or consent. All processing of personal data is done according to the data protection principles of the ERC Agency.

Automatic updates

The ERC Agency may from time to time automatically update or otherwise modify the Software, such as to correct errors and improve functions, while you are connected to the servers ERC Agency or third parties or at other times. These updates or changes may remove or alter the nature of the Software's features or other aspects of the Software. By accepting this Licence, you consent to such updates and changes.

Totality of agreement, relinquishment, partial invalidity

This Licence forms an entire agreement between you and the ERC Agency regarding the Software. If any part of this Licence is deemed invalid, unlawful or unenforceable, that provision shall apply as far as permitted to preserve the purpose of this Licence, while the other parts remain valid in their entirety.

Applicable law and jurisdiction

This Licence is governed by Finnish law, with the exception of the provisions relating to conflict of laws. Any disputes arising from this Licence shall be settled in the district court of your place of residence.
Termination
Without prejudice to any other rights conferred upon it, the ERC Agency may terminate this Licence if you fail to comply with any of its terms and conditions.

Amendments

The ERC Agency reserves the right to modify, by its sole authority, any terms and conditions of this Licence by publishing an announcement on the webpage specified by the ERC Agency, by email notification to the email address provided by the user, by issuing an announcement as part of the process by which you receive improvements/updates, or by issuing an announcement by any other legally recognised method of notice.

If you do not accept the change, you must contact the ERC Agency promptly for instructions. If you continue to use the Software after the effective date of the announcement referred to above, you will be deemed to have accepted and agreed to the change through your actions.
